Trade Secret Cases
In Vermont Microsystems, Inc. v. Autodesk, Inc., the court applied California trade secret law to hold that 1) misappropriation does not require exact duplication of the technology, only substantial derivation; 2) simply because independent development is plausible does not forgive misappropriation; and 3) the employment agreement that prohibited the employee from disclosing inventions or trade secrets was not unreasonable under the circumstances.
